The Case for Transgender Asylum From Trump’s America

Leaders of free nations of the world need to hear my message: Genocide has already started in plain view, and it is following the exact template of the last great genocide in Western society. So far, however, leaders who would otherwise decry the events of the 1930s and ’40s, and celebrate modern Pride months, refuse to even consider swinging wide the doors to their countries and offer asylum.

I understand that extraordinary claims require extraordinary evidence. Which is why I present the following:

The Trump administration is making public education inaccessible to transgender youth at all levels by threatening civil and criminal actions against school districts that allow transgender students to use bathrooms in accordance with their gender identity.

Recall that the Nazis forced nearly all Jewish children out of the public education system in 1933.

The Trump administration and its anti-trans supporters have leaned into every academic and athletic institution to ban transgender people from athletics, including chess.

The Nazis banned Jews of all ages from competing in virtually all athletics, including chess.

The Trump administration is in the process of effectively banning transgender people from higher education. Their agreement to restore funding to Brown University was predicated on banning transgender students from bathrooms and housing. It also requires placing a political officer at the school to ensure that no politically unacceptable ideas are being taught there, including “gender ideology.” Most other universities are expected to fall into line soon.

The Nazis systematically purged universities first of Jewish professors, and then students.

The Trump administration is expelling all 4,000-plus transgender people from the military, and in the process branding them with a discharge code that labels them a threat to national security. This nearly guarantees they will never find jobs in civil service or the defense industry, the two areas where they would otherwise be most qualified.

The Nazis expelled all 70 full-blooded Jews from the Reichswehr in 1934, but allowed half- and quarter-blooded Jews to remain as enlisted and non-commissioned officers.

The Trump administration is purging the federal service of transgender people via a combination of bathroom bans and firing of anyone deemed politically unreliable via DOGE and Schedule F. The intelligence community has already purged most of its transgender personnel.

The Nazis removed all Jewish civil servants in 1933 (except WWI veterans, who were later fired after Hindenburg’s death) via the Law for the Restoration of the Professional Civil Service (Gesetz zur Wiederherstellung des Berufsbeamtentums).

The U.S. Supreme Court, supported by the Trump administration, has ruled that people with gender dysphoria (i.e., all transgender people) are not a cognizable class, and therefore are subject only to rational basis scrutiny. The result of this is that if the federal government declared gender dysphoria as a communicable public health emergency, they would have every right to quarantine any individuals ever diagnosed with gender dysphoria.

In 1935, the Nuremberg Laws declared that Jews were residents of the Reich, and not citizens, meaning that they as a class had few if any civil rights, paving the way for the horrors to come.

The Trump administration is systematically cutting off transgender people of all ages from health care by either banning it outright, threatening all federal funding and legal action against any doctors or institutions that provide it. So far, they have been successful, especially at Veteran’s Affairs.

The Nazis cut Jews off from the public health system by forbidding Jewish doctors from receiving state funds, from going to medical school, and from being treated at state hospitals.

The Trump administration is using the DoJ to prosecute any company that receives federal funds to eliminate transgender employees by threatening them with civil rights violations if they let trans employees use bathrooms in accordance with their gender identity. 

The Nazis pursued an aggressive policy of “Aryanization” to induce employers to fire Jewish employees or take over Jewish-owned businesses.

The Trump administration comprises the architects of Project 2025, which declared that anything related to transgender people is inherently pornographic and should be illegal. The Heritage Foundation (the organization for Project 2025) has explicitly said that they intend to use the Kids Online Safety Act (KOSA) to achieve just that, making any online presence by a transgender person illegal. Drag bans at the state level have been so broad and overly vague that a transgender person would be forbidden from humming in public, or in the presence of children. 

In 1934 the Nazis made it illegal for Jews to perform in public, on stage, radio, the movies, or effectively any other venue.

The Trump administration is moving to ban transgender people from owning firearms and will likely succeed after the Skrmetti decision found that discriminating against people with a history of gender dysphoria meets only rational basis scrutiny. The administration is also developing a plan to combat “transgender terrorism” in the US.

The Nazis banned Jews from obtaining firearms licenses in 1936, and banned them from owning firearms or bladed weapons in November 1938.

The Trump administration has refused to issue passports to transgender individuals unless those passports have a gender marker on them that outs the individual as transgender, making immigration far more difficult, or even impossible.

In October 1938, the Nazis revoked all Jewish passports unless they were stamped with a large red “J” making immigration far more difficult, or even impossible.

Transgender people constitute about .5% of the U.S. population.

Jews constituted .5% of the German population in January 1933.

Leaders of the free world need to understand this: There is no hope of a meaningful life in the United States for transgender people for the exact same reasons life for Jewish people was more or less unlivable even before Kristallnacht. We cannot get an education, participate in society, participate in the civil service or the military. We cannot find employment because employers are being threatened by the federal government. We cannot hold clearances. We cannot get accurate passports. We will soon lose our ability to even be content creators on the internet, or performers of any sort.

None of this will get better for years, if ever. It will only get worse as the administration finds new and inventive ways to exploit rational basis scrutiny of discrimination against people who have ever been diagnosed with gender dysphoria. Reading through the Trump campaign website, he made it clear that transgender people are dangerous and mentally ill, and all dangerous mentally ill people should be put in mental institutions against their will. Given the nature of CECOT, we understand what conditions in those facilities are likely to be.

The only way to survive as a transgender person in the U.S. is to cease to be transgender. For those who have made a partial medical transition, their best hope of a meaningful life is to detransition, renounce their gender identity, and try to return to living in your assigned sex at birth. Those who have fully medically transitioned (i.e. surgery) likely won’t be able or won’t be allowed to return to living in their sex assigned at birth. Either way, the administration is clearly committed to causing serious bodily or mental harm and making conditions unlivable for trans people — all calculated to destroy a community and erase them from history. If there are no more transgender people left in the U.S. — because they have fled, gone into hiding, been locked up in mental institutions, e.g. — this is represents the physical destruction of a clearly definable sexual minority, and constitutes genocide.

And the Trump administration has made it clear that it is their goal to “get rid of transgender insanity.” (His words, not mine) The first rule of surviving autocracy is to believe the dictator. World leaders didn’t believe Hitler when he said that he would rid the world of Jewry. Now, they need to believe Trump when he clearly states his plans for transgender people, and we can see him putting them into action with a speed that even surpasses Hitler’s.

Leaders of the free world must therefore begin granting asylum to transgender people seeking to leave the United States. The situation here is hopeless, both in the sense of having a meaningful future here, or of conditions improving. They must not fear the wrath of Trump and should understand that he can no more be appeased than Chamberlain could appease Hitler. If leaders wait until after transgender people are being permanently confined against their will, it is already too late, and that looks to be the end state goal that the Trump administration is moving toward.

If I seem alarmist, I would ask the reader to look at the body of my work and see that my understanding of where the U.S. is going with regards to transgender people has proven prescient time and time again for over a decade. 

I would also ask every leader who has a chance to make a difference today: If you could go back in time, and allow Jews to seek asylum there before WWII, would you? Any decent human should reply with an unequivocal “yes”.

Given all the unsettling parallels I have highlighted above, why should your answer to transgender people today be “no”?
